Overview: Section 17 of House Bill 377 would have clarified that a judge can request access to confidential expungement records maintained by the Administrative Office of the Courts to determine whether a defendant has been previously granted a discharge or an expungement regardless of when the expungement petition was filed.
House Bill 377 was ratified by the General Assembly on August 6, 2026, but was vetoed by the Governor on August 17, 2026, and is not current law. If the General Assembly overrides the veto, Section 17 of House Bill 377 would become effective when it becomes law.
