Overview: Part V of S.L. 2026-19 (Senate Bill 153) waives governmental immunity from tort liability for local governments that adopt sanctuary ordinances when an unauthorized alien commits a crime against a person or property within its corporate limits, regardless of whether the local government has purchased liability insurance.
This bill was vetoed by the Governor on June 20, 2025, and that veto was overridden by the General Assembly on June 24, 2026. This part became effective June 24, 2026.
