Overview: Section 43.8 of S.L. 2026‑41 (Senate Bill 257) authorizes Department of Transportation (Department) capital projects in the 2026‑2027 fiscal year based upon projected cash flow needs. It also states the intent of the General Assembly to fund these capital improvement projects on a cash flow basis and plans for future project funding based upon projected availability in the 2027‑2028 and 2028‑2029 fiscal years. The capital projects are as follows: (i) Manns Harbor Water Infrastructure Overhaul; (ii) Wake County Maintenance Yard; and (iii) Jones County Maintenance Yard.
This section also requires, no later than March 1, 2027, and every year thereafter until project completion, the Department to report on the use of these funds to the House of Representatives Appropriations Committee on Transportation, the Senate Appropriations Committee on the Department of Transportation, the Joint Legislative Transportation Oversight Committee, and the Fiscal Research Division.
This section became effective July 1, 2026.
