Overview: Section 43.20 of S.L. 2026‑41 (Senate Bill 257), as amended by Section 11.7 of S.L. 2026‑61, amends the laws that regulate outdoor advertisements adjacent to certain interstate and federal‑aid primary highways by:

  • Amending lawfully existing sign relocation conditions and site criteria.
  • Creating a timeline for permit review and creating additional procedures to address permit holder violations.
  • Prohibiting the Department of Transportation from pursuing amendments or modifications to the agreement between this State and the United States Department of Transportation implementing the federal Highway Beautification Act of 1965 without General Assembly approval,
  • Prohibiting the delegation or transfer of permitting, enforcement, or other core regulatory authority under the Outdoor Advertising Control Act to any county, municipality, or other political subdivision of the State.
  • Amending outdoor advertising vegetation cutting and removal permit processes.

This section became effective July 1, 2026.
