Overview: Section 28 of S.L. 2026-46 (House Bill 1094) requires the Division of Motor Vehicles (DMV) to amend its rules on enrollment contract refunds to provide for a 100% refund if the student withdraws at any time before the first instruction hour, a 75% refund, minus nonrefundable fees, after receiving 10% of the scheduled instruction hours, and no refund thereafter. For purposes of determining the number of hours received, home study or digital course materials are counted but do not preclude a 100% refund if the student withdraws within 5 days of having access to the materials and before in-person instruction begins.
This section became effective July 7, 2026, and expires on the date rules required by this section become effective.
