Overview: Section 20 of S.L. 2026‑46 (House Bill 1094) amends provisions applicable to personal delivery devices by (i) increasing their allowable size from 40 to 55 inches long and from 30 to 36 inches wide, (ii) allowing their use on highways (currently only allowed as necessary to cross or when a sidewalk is not accessible), (iii) allowing their use on highways with speed limits up to 55 mph (currently 35mph), and (iv) applying, to personal delivery devices, rights and duties of a pedestrian in pedestrian areas and the operator of a bicycle in other areas (e.g., highways, bicycle lanes, shoulders, parking lots).
This section becomes effective December 1, 2026, and applies to offenses on or after that date.
