Overview: Section 5.12 of S.L. 2026-41 (Senate Bill 257) amends the statute governing the State Building Commission's (Commission) powers and duties over the State's capital facilities development and management program. The Commission has authority to adopt rules establishing procedures and criteria to ensure that certain professionals have the necessary qualifications and experience for a capital improvement project. Subject to some exceptions, the rules must ensure that the Commission, after consulting with the funded agency, is responsible for the final selection of the designer, consultant, or construction manager at risk. This section provides that when the Eastern North Carolina School for the Deaf, the North Carolina School for the Deaf in Morganton, or the Governor Morehead School for the Blind are the funded agencies, those agencies are subject to the Commission's rules except those agencies are responsible for the final selection of the designer, consultant, design-builder, or construction manager at risk.
This section became effective July 1, 2026.
