S257 - 2026 Appropriations Act. (SL 2026-41)

• Provides that the North Carolina State Building Code in effect on January 1, 2027, is not affected by the establishment of the Building Codes and Interpretations Bureau.
• Extends the initial term of office for seats on the Building Code Council and Residential Code Council by one year.
• Transfers the Building Code Council, Residential Code Council, and Code Interpretations Section to the Department of Labor. This transfer is not to be construed to transfer the statutory powers of the Building Code Council or the Residential Code Council to the Department of Labor with certain limited exceptions.
• Facilitates the transfer of certain employees and rules as a result of the establishment of the Building Codes and Interpretations Bureau and related organizational transfers.  
• Provides that transfers will not impact pending actions, proceedings, or ongoing investigations, or ongoing decisions, interpretations, or orders.
• Provides that the Department of Labor, the Office of State Budget and Management, the State Controller, the State Treasurer, and the Office of the State Fire Marshall may take certain preparatory action necessary to implement this section and other provisions related to the establishment of the Building Codes and Interpretations Bureau.

The portion of the section extending the initial term of office for seats on the Building Code Council and Residential Code Council became effective July 7, 2026. The portions providing for preparatory action became effective July 1, 2026. The remainder of the section becomes effective January 1, 2027.
