Overview: Section 19.1 of S.L. 2026-41 (Senate Bill 257) prohibits the Office of State Budget and Management from transferring any positions, personnel, or funds from any of the following State agencies to any other State agency during a fiscal biennium, unless the transfer is included (i) in the base budget for one or both years of that biennium or (ii) otherwise authorized by legislation enacted during or applicable to that biennium:

  • The Department of Public Safety.
  • The Department of Adult Correction.
  • The State Bureau of Investigation.
  • The State Highway Patrol.

This does not apply to the consolidation of information technology positions into the Department of Information Technology pursuant to general law.

The section became effective July 1, 2026, and applies to transfers on or after that date.
