S257 - 2026 Appropriations Act. (SL 2026-41)

• Directs non-ex officio members of the Local Government Commission to finish their current terms on the Commission.
• Requires that the new member for a current, non-ex officio member's seat be appointed prior to the expiration of the non-ex officio member's current term.
• Requires that if a vacancy occurs before the expiration of a non-ex officio member's current term, the vacancy be filled pursuant to the provision establishing the Commission.
• Directs non-ex officio seats on the Commission be filled as follows:
  • The General Assembly upon the recommendation of the President Pro Tempore of the Senate must make an appointment to fill any vacancy occurring in the seat held by the Secretary of State prior to June 30, 2029, and thereafter.
  • The term of the member appointed by the Governor serving as a current or former member of the governing board of a city continues until June 30, 2029. After this date, the appointment to this seat remains with the Governor. The Governor must make an appointment to fill any vacancy occurring in this seat prior to June 30, 2029, and thereafter.
  • The term of the member appointed by the Governor serving as an at-large member continues until June 30, 2029. After this date, the General Assembly upon the recommendation of the Speaker of the House of Representatives must make an appointment to fill the seat. If the seat becomes vacant prior to June 30, 2029, the Speaker must make an appointment to fill the seat for any partial term and any terms thereafter.
  • The term of the member appointed by the Governor serving as a current or former member of a county board of commissioners continues until June 30, 2029. After this date, the State Treasurer must make an appointment to fill the seat. If the seat becomes vacant prior to June 30, 2029, the State Treasurer must make an appointment to the seat to fill any partial term and any terms thereafter.
  • The term of the member appointed by the General Assembly upon the recommendation of the President Pro Tempore of the Senate serving as an at-large member continues until June 30, 2029. After this date, the appointment to this seat remains the President Pro Tempore. The General Assembly upon the recommendation of the President Pro Tempore must make an appointment to fill any vacancy occurring in this seat prior to June 30, 2029, and thereafter.
  • The term of the member appointed by the General Assembly upon the recommendation of the Speaker of the House of Representatives serving as an at-large member continues until June 30, 2029. After this date, the appointment to this seat remains with the Speaker. The General Assembly upon the recommendation of the Speaker must make an appointment to fill any vacancy occurring in this seat prior to June 30, 2029, and thereafter.
