Overview: Section 5.11 of S.L. 2026-41 (Senate Bill 257) provides that counties and cities may operate public enterprises for water supply and distribution systems of all types, including dams, reservoirs, water intakes, water treatment facilities, and any infrastructure associated with that service or system. It also makes conforming changes to the definition of "water" in specific property tax statutes for counties and cities.
This section became effective July 1, 2026.
